These Terms of Service (“Terms”) govern the use of the AFFECT Magazine website and online shop (“Service”, “Site”) and all purchase contracts between you (“Customer”) and AFFECT Magazine GbR (“we”, “us”, “our”). By using our Site or placing an order, you agree to these Terms.

2. Scope
2.1 These Terms apply to all contracts for products, subscriptions, or digital goods ordered via our Site.
2.2 Separate agreements or regulations explicitly referenced remain valid.
3. Contract Conclusion
3.1 Product descriptions are invitations to make an offer.
3.2 A contract is concluded when:
we send an order confirmation, or
we deliver the ordered goods, or
we request payment.
3.3 The contract text is stored and sent to you by email. Access to contract texts on our servers is not provided beyond this.
4. Eligibility
4.1 You confirm that you are legally able to enter into contracts in your jurisdiction.
4.2 You must not use our Service for unlawful purposes.
5. Prices and Payment
5.1 All prices are in Euros (€) and include statutory VAT, unless stated otherwise.
5.2 Shipping costs are shown at checkout.
5.3 Accepted payment methods: credit/debit cards, SEPA transfer, PayPal, Apple Pay, Google Pay, and others.
5.4 Payment is due at the time of order, unless otherwise agreed.
6. Delivery and Shipping
6.1 Delivery is made to the address you provide.
6.2 For international deliveries outside the EU, customs duties or bank fees may apply and are your responsibility.
7. Customer Accounts
7.1 You are responsible for correct account information and safeguarding your password.
7.2 You may delete your account at any time by contacting us. Data will be deleted unless required for legal retention periods or ongoing contracts.
8. Newsletter and Direct Marketing
8.1 Newsletter Subscription:
Requires only your email; optional additional data may be provided.
Double opt-in ensures your consent under Art. 6(1)(a) GDPR.
IP address, date, and time are recorded for verification.
You may unsubscribe at any time.
8.2 Direct Marketing for Existing Customers:
Based on our legitimate interest (Art. 6(1)(f) GDPR).
Offers for similar products/services may be sent.
You can object at any time at no cost; marketing emails will cease immediately.
9. Order Processing
9.1 Personal data is shared only as needed with banks and shipping companies (Art. 6(1)(b) GDPR).
9.2 If digital updates are required, your contact data is used solely for this purpose (Art. 6(1)(c) GDPR).
9.3 Cancellation of Recurring Contracts:
Subscription contracts may be cancelled electronically according to deadlines.
Data required for identification and confirmation will be processed for this purpose only.
10. Withdrawal / Cancellation Rights
10.1 Consumers have statutory withdrawal rights for distance contracts.

11. Liability and Disclaimer
11.1 We create content with care. Liability for our content is per §7 TMG and general laws.
11.2 We are not obliged to monitor third-party content but will remove illegal content when informed.
11.3 We are not responsible for external links. Links will be removed upon notice of illegality.
12. Intellectual Property / Copyright
All content on the Site is protected under German copyright law. Reproduction or commercial use requires written consent. Third-party content is clearly marked. Any observed copyright infringement will be removed immediately upon notice.

We implement technical and organizational measures to protect personal data, but complete security during transmission cannot be guaranteed.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Germany.
For disputes with consumers, mandatory rights in your country cannot be waived.

15. Changes to Terms
We may update these Terms. The updated version is posted on the Site with a “Last Updated” date. Continued use after changes constitutes acceptance.
16. Cancellation / Returns (Widerrufsbelehrung)
Consumers (private persons) have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day you or a third party (other than the carrier) obtains physical possession of the goods.

You may use our withdrawal form, but it is not mandatory.
Costs for returning the goods are borne by the consumer unless otherwise stated.
17. Warranty / Defects
All goods are subject to the statutory warranty rights under German law.
Consumers have the right to request remedy in case of defective goods, either by repair or replacement.Further legal rights remain unaffected.
18. Retention of Title / Ownership
Delivered goods remain the property of AFFECT Magazine GbR until full payment is received.
